Extended Producer Responsibility

EPR principle refers to an environmental policy approach that extends the producer’s responsibility to the post-consumer stage of a product’s lifecycle.

EPR policies are expected to incentivize product design for a better reuse and recycling.

Under EPR, producers are the main stakeholders responsible for the entire life cycle of a product, including its end-of-life stage.

The core idea behind the EPR approach is that producers will try to minimize the end-of-life (EoL) cost of their products, if they have to organize and finance transport and treatment of the waste from the EEE they put on the market.

History

  • The origins of EPR are attributed to Sweden’s Thomas Lindhqvist who in 1990, on behalf of Lund University, introduced the idea of manufacturer’s being responsible for their products to the Swedish Ministry of the Environment.
  • Germany introduced the first example of EPR in Europe in 1991 with a requirement that manufacturers assume responsibility for recycling or disposing of packaging material they sold. In response, German industry set up a ‘dual system’ for waste collection, picking up household packaging alongside municipal waste collections.
  • In 1994 the EU adopted the Packaging Directive, creating union-wide targets for recycling while allowing individual countries discretion in implementation.

EPR: Types of instruments

Administrative instruments:

For instance, it is required that producers finance product take-back programmes and/or impose substance and landfill restrictions.

Economic instruments:

An example of this is the requirement for financing waste management costs (including collection and recycling) through tax- es or a centralized fee structure.

Informative instruments:

Governments may require producers to re- port to relevant authorities and place specific consumer information on products.

Possible activities in a EPR system

The 4 principles below are the foundation to guide effective WEEE management. Applied together, those principles aim to create a fair, sustainable and environmentally sound system for managing WEEE.

Creating take-back programmes

Arranging waste collections, recycling or another suitable disposal

Designing products for reuse or recyclability

Collective responsibility (Producer Responsibility Organization (PRO), Finance collection and treatment Manage data, Organise/supervise activities)

Benefits and Requirements of EPR

EPR offers benefits like:

  • Generation of positive PR opportunities
  • Additional marketing tool which can be used when bidding for tenders/new customers
  • Improved environmental credentials
  • Competitive advantage over others in your industry
  • Can create jobs in local communities
  • Strengthened customer loyalty

The regulations require businesses to:

  • Minimise waste arising from these products and promote their re-use
  • Ensure the waste products are treated and meet recovery and recycling targets for the waste materials
  • Design products by reducing material use and enhancing reusability and recyclability

IPR vs EPR

Individual Producer Responsibility (IPR)

  • Individual (on a producer level)
  • “each producer shall be responsible for financing the collection and treatment relating to the waste from his own products.”
  • Responsible for own products encourages better design from the producer.
  • Encourages longevity/durability.
  • Investigates the impact the design of a company’s products have on the recycling.
  • Incentivises design for the environment.

Extended Producer Responsibility (EPR)

  • Collective (on a multi-producer level)
  • “producers are responsible for recycling WEEE”. Addressing the problem collectively.
  • Producers being jointly responsible for the recycling of all products provides little / no incentive for better design of products
  • Does not necessarily encourage longevity/durability.
  • Badly designed products will hit all producers equally.
  • Funds collection can be a challenge a bring disagreements among the producers.

Example of EPR scheme - Europe

  • In Europe, the Waste Electrical and Electronic Equipment (WEEE) Directive regulates e-waste collection and recycling at the level of the European Union (EU) and is part of a larger trend towards Extended Producer Responsibility (EPR). It sets targets for e-waste collection and recycling. Products must be labelled to inform consumers about the obligatory separate collection of e-waste.
  • The Directive makes producers responsible for the end-of-life treatment of their products. The law also prescribes recycling standards and provides guidelines for recycling facilities. All EU member states are obliged to transpose and implement the Directive.
  • The details of how to establish an accessible system that allows consumers to return their e-waste free of charge, how to design an EPR system, and how to achieve the collection targets are up to the EU member states.

Example of EPR scheme – United States of America

Example of EPR scheme –South Africa

  • South Africa’s EPR scheme, under the National Environmental Management: Waste Act, requires producers to manage the lifecycle of WEEE, including its recovery, take-back, and treatment, since November 2021.
  • Certain WEEE categories are banned from landfills to encourage sustainable handling, but compliance and awareness remain challenges.
  • A national WEEE policy framework and operational standards for facilities are being developed (2024) to streamline regulations and improve management.
